Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MindFlow mobile application and related services (collectively, the "Service") provided by MindFlow ("we," "our," or "us").

Acceptance of Terms

By downloading, accessing, or using MindFlow, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use MindFlow. If you are under the age of majority where you live, you may use the Service only with the consent of a parent or legal guardian.

Your use of MindFlow is also governed by our Privacy Policy, which describes how we collect and use information.

Use of Service

MindFlow is a meditation and mindfulness practice app that offers practice paths, progress tracking, goals, reflection features, and related tools. The Service is provided for personal, non-commercial use unless otherwise agreed in writing.

MindFlow provides meditation and mindfulness content for general wellness and educational purposes. It is not medical advice, mental health treatment, or a substitute for professional care. Do not disregard professional medical or psychological advice because of content in the app. If you have a medical or mental health emergency, contact a qualified professional or emergency services immediately.

MindFlow may integrate with third-party services (such as Firebase and sign-in providers). Your use of those services may be subject to separate terms and privacy policies. We are not responsible for third-party services.

User Responsibilities

To use certain features, you must create an account. You agree to:

• Provide accurate and current information
• Keep your login credentials secure
• Notify us promptly of unauthorized access to your account
• Accept responsibility for activity that occurs under your account

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service
• Reverse engineer, decompile, or attempt to extract source code except as permitted by law
• Upload or transmit harmful, abusive, or infringing content
• Use automated means to access the Service without permission

We may suspend or terminate accounts that violate these Terms or pose a security risk. You may stop using MindFlow at any time.

Intellectual Property

The Service, including its design, text, graphics, audio, software, and branding, is owned by us or our licensors and is protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

If you submit content through the Service (such as profile information or practice notes), you retain ownership of your content. You grant us a license to host, store, and process that content solely to operate and improve the Service. You represent that you have the rights to any content you submit and that it does not violate the rights of others.

Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (US $100), WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. You agree to indemnify and hold harmless MindFlow and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

These Terms are governed by the laws applicable in the jurisdiction where MindFlow operates, without regard to conflict-of-law principles, except where mandatory local consumer protections apply.

Changes to Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Material changes may be communicated through the app or other reasonable means. Continued use after changes become effective constitutes acceptance of the updated Terms.

Upon termination of your access, provisions that by their nature should survive will remain in effect, including disclaimers, limitations of liability, and indemnification.
